*11/10/17 Notice: UCR fees are due annually and normally collected by the UCR Board of Directors ("Board") in the 4th quarter between October 1 and December 31 for the upcoming year. UCR is NOT prorated and goes by the calendar year. As we previously advised, there is currently a Federal Lawsuit challenging the Board's decision to change the 2018 UCR open date from the annual October 1st open date that appears in the UCR Agreement and suggests that current FMCSA rulemaking to change the fees is unlawful because it did not act within 90 days of receiving recommended fees from the Board. In the meantime, on October 26, 2017, the Board issued a statement that it does not know when the 2018 UCR filing period will open due to pending legal matters and that they have recommended --although cannot compel-- that states not enforce 2018 UCR until 90 days after the Board actually opens the filing period. We therefore recommend that you make every effort to renew for 2018 UCR on or before the December 31, 2017 deadline in the Unified Carrier Registration Agreement in order to be certain you will avoid state enforcement action against you, presuming the 2018 UCR filing period is open by then. On November 2, 2017, the Court was advised by the parties in the suit at the Court's direction that the Board did not open 2018 UCR on November 1st, 2017 as previously planned, and that FMCSA is still proceeding with new 2018 UCR fee rulemaking, despite having not acted within the statutory 90 days of receiving recommended fees from the Board. We are therefore currently accepting advance 2018 UCR orders at 2017 rates in anticipation of an imminent Court-ordered preliminary injunction against the Board's continued delay due to the likelihood that any final change in UCR fees for UCR year 2018 will be deemed unlawful, and due to the expected rush to avoid missing the December 31st deadline set by the UCR Agreement that will result from a drastically shortened compliance period that is normally 90 days. In the unlikely event a downward adjustment to the 2018 UCR fee schedule is deemed lawful, a credit will be issued to you.
